UPmarket Event Terms & Conditions

Welcome to The Hills UPmarket, an event run and managed by UPmarket Events.

1. Market Information: The Hills UPmarket ("the Market") is organised by UPmarket Events (“the Organiser”) and will take place at The Venue that is leased to Upmarket & Positive Vibes Foundation by Hills Shire Council - “The Terraces” at The Showground, Castle Hill, NSW 21. The event runs on 4th Sunday of each month except in January when we take an event holiday, and in December a Twilight market is organised, where possible on the 1st or 2nd Saturday. The Stallholders (Vendors) are expected to read and abide by the following terms and conditions of the event. 
2. Market Dates and Hours: The Market will be open for business to the public from 9am-2pm on each event date and the vendors are to arrive ready for bump in on the day. Food vendors are permitted entry from 6.30am to set up and boutique vendors are permitted entry from 7am.
3. Participation Eligibility: The Market is open to local producers, growers, artisans, and local small business owners who offer quality products that are locally sourced or handmade. All vendors must adhere to relevant local council rules and regulations regarding the sale of their products and must provide a copy of their own current PLI (Public Liability Insurance), min $10m and relevant Hills Shire Council & Food Safety NSW Food Service Certificates.

4. Application Process: To participate in the Market, interested vendors must complete an application form provided by the Organiser. The Organiser reserves the right to accept or reject any application at their sole discretion. Please use the webform 
5. Product Eligibility: Products allowed at the Market include, but are not limited to:
•    Locally grown fresh fruits and vegetables
•    Handmade crafts and artisanal products
•    Homemade baked goods and preserves
•    Natural and organic beauty and skincare products
•    Local small business services
•    Farm-produced honey, eggs, and dairy products
Products that do not align with the Market's theme, are not locally sourced, or do not meet quality standards set by the Organiser may not be permitted. If you are unsure at any time of the eligibility of your products please contact us
6. Stall Allocation: Stall spaces are available in 3m x 3m or 3m x 6m sizes and will be allocated by the Organiser based on the nature of the vendor's products and the order of application. Vendors may not sublet, share, or transfer their allocated stall space without prior written consent from the Organiser.

Stall locations are based upon each event stall mix and the layout is uploaded the night before the event onto our UPmarket Stallholder Facebook Group page so that all vendors have their stall number ready when they arrive at the venue for bump in.

7. Stall Setup and Safety: Vendors are responsible for providing their own gazebo (3mx3m) and merchandising tables and chairs and for setting up their stalls in the allocated space provided, clearly marked with spray painted dots and numbers on the ground. PLEASE NOTE: It is  not always possible to drive onto the terraces and unload – please be prepared to park your car a short distance away from your stall and bring a trolley to transport your products.
Vendors are responsible for arriving well before the Market opens and dismantling their stall and bumping out after the Market closes. All vendors must comply with safety regulations and maintain a clean and hazard-free environment within their stalls and have left the venue by 3pm.

8. Insurance and Liability: All vendors are required to have valid public liability insurance and to indemnify the Organiser against any claims, damages, losses, or expenses arising from their participation in the Market. Your event application is NOT complete without ALL relevant insurances and food standard certificates.
9. Pricing and Sales: Vendors have the liberty to set their own prices for their products. All sales must be conducted in Australian Dollars (AUD). Vendors are responsible for collecting and keeping safe all monies for their products.
10. Marketing and Promotion: The Organiser will undertake marketing and promotional activities to promote the Market. Vendors are encouraged to promote their participation in the Market through their own channels, such as social media and websites.
11. Compliance with Laws: Vendors must comply with all relevant laws and regulations concerning health, safety, food handling, labelling, and other applicable requirements.
12. Cancellations and Refunds: 
What happens if WE, the Market Organiser cancels an event?
If the Organiser is forced to cancel due to weather conditions being unsafe for our event, stallholders and customers you will be notified as soon as possible up until the morning of the day before the event. This communication will be published on out the UPmarket Stallholder Facebook group page. You can choose one of the following options:
•    Cancellation by the Organiser 1 day (24hrs) or less before the Market day: The opportunity to transfer your payment to another Market date (within 3 months of the cancelled event date)
OR:
•    Receive a refund of the stall fee paid minus a 20% admin and promotion fee
What happens if YOU , the Vendor pull out of the event?
As you can appreciate there is a lot that goes on behind the scenes in preparation to help ensure that the event runs as smoothly as possible on the day. When you, the Vendor cancels at the last minute (less than 7 days before the event), for whatever reason it makes the job of the Organiser much harder and there are extra manhours involved to fill your spot in the layout. Also please bear in the mind that if a product category has been held for you and you pull out, you not only leave the product category excluded from the event and not represented but you have also meant that another stallholder misses out on a trading opportunity at the Market.
If a Vendor needs to cancel their participation, they must notify the Organiser as soon as possible in writing please contact us or by calling Anne or Jasmin
•    Cancellation by you, the Vendor 14 days or more before the Market: The opportunity to transfer your payment to another Market date (within 3 months of the cancelled event date)
•    Cancellation by the Vendor between 7 and 14 days before the Market: 80% refund
•    Cancellation by the Vendor less than 7 days before the Market: NO refund

13. Changes to Terms and Conditions: The Organiser reserves the right to make changes to these Terms and Conditions at any time. Vendors will be notified of any updates or modifications via the UPmarket Stallholder Facebook group page .
By participating in The Hills UPmarket event, Vendors agree to abide by these Terms and Conditions. The Organiser reserves the right to take appropriate action, including expulsion from the Market, for any violation of these Terms and Conditions.

14. Vendor Conduct
As a vendor participating in the UPmarket Boutique event, you are expected to maintain a high standard of personal conduct and professionalism. Your behaviour not only reflects on you but on the entire event and its reputation. To ensure a positive and harmonious environment for all attendees, we kindly request that you adhere to the following guidelines:

  • Respect and Courtesy: Treat all market visitors, fellow vendors, staff, and organizers with respect and courtesy. Be polite and attentive to customers' needs and engage in friendly interactions.

  • Honesty and Integrity: Be honest and transparent in your business practices. Provide accurate information about your products, prices, and any relevant details to customers. Avoid misleading or deceptive practices.

  • Professional Appearance: Present yourself in a clean, neat, and professional manner. Maintaining a tidy appearance showcases your commitment to quality and attention to detail.

  • Compliance with Laws and Regulations: Adhere to all local, state, and federal laws and regulations relevant to your products and business operations. This includes licensing, permits, food handling, labeling, and any other applicable requirements.

  • Product Knowledge: Be knowledgeable about the products you are selling. Be ready to answer customer questions about your products' origin, ingredients (if applicable), and any other relevant details.

  • Display and Booth Maintenance: Keep your booth area clean, organized, and visually appealing. Regularly restock and arrange your products to create an inviting display for customers.

  • Noise and Disturbances: Keep noise levels at an appropriate and considerate level, ensuring that it does not disrupt neighboring vendors or the overall market atmosphere.

  • Conflict Resolution: In case of any disputes or conflicts with customers, other vendors, or market staff, maintain a calm and composed demeanor. Seek resolution in a respectful and constructive manner.

  • Adherence to Market Rules: Abide by the rules and guidelines set forth by the Farmers' Boutique Market, including those related to setup times, booth allocation, safety regulations, and vendor conduct.

  • No Unauthorized Solicitation: Avoid engaging in aggressive or unauthorized solicitation of customers or other vendors. Respect their space and allow them to approach your booth willingly.

  • No Smoking or Alcohol Consumption: Smoking and alcohol consumption are strictly prohibited within the market premises.

  • Compliance with Organizer's Instructions: Follow any instructions or directives given by the market organizers promptly and willingly.

  • Report any Issues: If you encounter any problems or observe any concerning behavior during the market, please report it to the market organisers immediately-call Anne or Jasmin

Failure to comply with these guidelines may result in warnings, fines, or expulsion from the Event. The organisers reserve the right to take appropriate action in response to any breach of conduct that may adversely affect the market's reputation and the experience of other vendors and visitors.
By participating in the Market, you acknowledge that you have read and understood these guidelines and agree to uphold them throughout the duration of the market.
